Terms and Conditions – Laluna’s Boutique

Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

  • Cooling-off period: the period within which the consumer may exercise their right of withdrawal.

  • Consumer: the natural person not acting in the exercise of a profession or business who enters into a distance contract with the entrepreneur.

  • Day: calendar day.

  • Long-term transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.

  • Durable medium: any tool that enables the consumer or entrepreneur to store information addressed to them personally in a way that allows future consultation and unaltered reproduction of the stored information.

  • Right of withdrawal: the consumer’s option to withdraw from the distance contract within the cooling-off period.

  • Entrepreneur: Laluna’s Boutique, the natural or legal person who offers products and/or services at a distance to consumers.

  • Distance contract: an agreement concluded between the entrepreneur and the consumer within the framework of an organized system for the distance selling of products and/or services, using one or more means of distance communication.

  • Means of distance communication: any tool that can be used to conclude a contract, without the consumer and the entrepreneur being in the same place at the same time.

  • Terms and Conditions: the present Terms and Conditions of the entrepreneur.

Article 3 – Applicability

These Terms and Conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

Before a distance contract is concluded, the text of these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated where the Terms and Conditions can be viewed or that they will be sent free of charge upon request.

Article 4 – The Offer

The offer is non-binding. Errors or mistakes do not bind the entrepreneur.

The offer includes a clear description of the products and/or services offered. Product images are as accurate as possible, but colors may differ due to screen settings.

Prices are exclusive of import duties, customs fees, and local taxes of the destination country. These costs are always borne by the consumer.

Article 5 – The Agreement

The agreement is concluded at the moment the consumer accepts the offer and meets the stated conditions.

Orders are confirmed electronically. The entrepreneur reserves the right to refuse orders in cases of fraud, payment issues, or misuse.

Article 6 – Right of Withdrawal

Consumers have the right to withdraw from the agreement within 14 days after receipt of the product, without stating reasons, unless the product is excluded (see Article 8).

Returns are at the consumer’s expense and must be sent back in original condition and packaging.

Article 7 – Costs in Case of Withdrawal

If the consumer exercises the right of withdrawal, the return shipping costs are fully borne by the consumer.

Refunds will be issued within 14 days after the returned items have been received or proof of shipment has been provided.

Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to:

  • Hygiene-sensitive items once unsealed.

  • Custom-made or personalized products.

  • Digital goods or downloads.

Article 9 – Prices

Prices may fluctuate due to exchange rates and international market conditions.

All prices are exclusive of import duties, customs clearance fees, and local taxes. These additional costs are always the responsibility of the consumer.

Article 10 – Conformity and Warranty

Products must meet reasonable expectations of quality and usability. Warranty does not apply in cases of misuse, modifications, or damage caused by the consumer.

Article 11 – Delivery and Execution

Orders are shipped from the United States or international warehouses. Estimated delivery times are 5–14 business days, but may vary due to customs, weather, or unforeseen delays.

The risk of loss or damage passes to the consumer once delivery has been made.

Article 12 – Long-Term Transactions: Duration, Termination, and Renewal

  • Contracts for indefinite periods may be terminated by the consumer at any time, subject to a maximum notice period of one month.

  • Contracts for fixed periods may be terminated at the end of the agreed duration, also with a maximum notice period of one month.

  • Automatic renewal of contracts is only permitted under conditions favorable to the consumer.

Article 13 – Payment

Payment must be made in advance using the available payment methods. Incorrect data must be corrected by the consumer immediately.

In cases of non-payment, the entrepreneur has the right to charge reasonable collection costs, provided these were communicated in advance.

Article 14 – Complaints Procedure

Complaints about the execution of the agreement must be reported within 7 days after discovery via support@lalunasboutique.com.

The entrepreneur will respond within 14 days. If resolution is not possible, disputes may be submitted to the competent courts in the United States.

Article 15 – Disputes

Only the laws of the United States (State of Delaware, USA) apply to agreements between Laluna’s Boutique and the consumer.

Even if the consumer resides outside the USA, U.S. law remains exclusively applicable.
